This Privacy Policy explains how GFL Capital Mortgage (“GFL Capital Mortgage,” “we,” “us,” or “our”), NMLS #64367, collects, uses, and shares information through gflcapital.com and related online services (the “Site”), including our contact forms, calculators, account pages, document upload page, and text messaging program. By using the Site, you agree to this Privacy Policy and our Terms of Use.
If you apply for a mortgage loan with us, the nonpublic personal information you provide in connection with that loan is also covered by our Gramm-Leach-Bliley Act (GLBA) Privacy Notice, which we provide to you during the loan process. If that notice and this Privacy Policy conflict for information collected in connection with your loan, the GLBA Privacy Notice controls.
1. Information We Collect
Information you give us. This includes your name, email address, phone number, and messages you send through our contact forms; information you provide when you create an account; and, if you apply for a loan, information such as your address, income, employment, assets, debts, Social Security number, and documents you upload.
Information collected automatically. When you visit the Site, we and our service providers may collect your IP address, browser and device type, pages viewed, referring pages, and the date and time of your visit, using cookies and similar technologies.
Calculator inputs. Figures you enter into the Site’s mortgage, refinance, and debt-to-income calculators are used to display results on your screen.
2. How We Use Information
- To respond to your inquiries and provide customer service
- To evaluate, process, and service your loan application and loan
- To send account notifications and customer care messages by email, phone, or text (text messages only with your consent)
- To operate, secure, and improve the Site, including preventing fraud and spam
- To comply with legal, regulatory, and licensing obligations
3. How We Share Information
We do not sell your personal information. We do not share your financial or personal information with third-party lenders, affiliates, or marketing partners for their marketing or promotional purposes. We share information only as needed to provide the services you request and to meet our legal obligations, as described below:
- Service providers that perform services for us, such as website hosting, email delivery, our secure loan application portal (currently Floify), analytics, and spam protection, under obligations to protect your information
- Loan processing only as needed to process and close a loan you have applied for, such as the lender funding your loan, credit reporting agencies, appraisers, title and escrow companies, and insurers. These parties may use your information only to complete your loan transaction, not to market to you.
- Legal and regulatory recipients when required by law, regulation, court order, or regulatory examination, or to protect our rights and the safety of others
- Business transfers in connection with a merger, acquisition, or sale of all or part of our business
The categories above do not include text messaging originator opt-in data and consent. See Section 4.
4. Text Messaging (SMS)
If you check the SMS consent box on one of our forms, you agree to receive account notification and customer care text messages from GFL Capital Mortgage at the phone number you provided. Opting in is optional and is not required to submit a form, apply for a loan, or use our services.
- Message frequency varies. Message and data rates may apply.
- To stop receiving messages, reply STOP at any time. You will receive one message confirming that you have been unsubscribed.
- For help, reply HELP or email info@gflcapital.com.
- Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Mobile phone numbers collected for SMS are used only to send the messages you agreed to receive.
5. Cookies and Tracking
We use cookies and similar technologies to remember your preferences, keep you signed in, understand how the Site is used, and protect our forms from spam. We use services such as Google Tag Manager and Google reCAPTCHA, which may set their own cookies and collect information under their own privacy policies. You can block or delete cookies in your browser settings, though some parts of the Site may not work properly without them.
Do Not Track. Some browsers send “Do Not Track” signals. The Site does not currently respond to these signals.
6. Your Choices
- Email: use the unsubscribe link in any marketing email, or contact us. We may still send messages related to your loan or account.
- Text messages: reply STOP to any message.
- Your information: contact us to ask what information we have about you or to request that we correct or delete it. Some information must be kept to meet legal and regulatory record-keeping requirements.
7. California Residents
Depending on how California privacy law applies to us and to your information, California residents may have the right to know what personal information we collect, use, and disclose; to request deletion or correction of personal information; to opt out of the sale or sharing of personal information; and not to be discriminated against for exercising these rights. We do not sell or share personal information for cross-context behavioral advertising. 8. Data Security and Retention
We use administrative, technical, and physical safeguards designed to protect your information, including encrypted (HTTPS) connections and limiting access to employees and service providers who need it. No method of transmission or storage is completely secure. Please do not send sensitive information such as Social Security numbers by regular email; use our secure document upload page or application portal. We keep information as long as needed for the purposes described above and as required by law.
9. Children
The Site is not intended for anyone under 18, and we do not knowingly collect personal information from children under 13.
10. Links to Other Sites
The Site links to third-party websites, including our application portal, lender partners, and government resources. Their privacy practices are governed by their own policies, not this one.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page with a new effective date. Continued use of the Site after changes are posted means you accept the updated policy.
